This document provides notice of specific legal obligations in connection with your use of our Internet or “web” sites (collectively, “Site” or “Sites”). By using this Site, you agree to be bound by our Terms of Service and Privacy Policy (collectively, “Terms of Service”), in addition to other terms and conditions that may appear throughout our Sites. AKITA – Personal Dog Trainer (“AKITA”) reserves the right to make changes to this Site and the Terms of Service at any time. Each time you use this Site, you should visit and review the then current Terms of Service that apply to your transactions and use of this Site. If you do not agree to be bound by the then-current Terms of Service, your sole remedy is not to use this Site. AKITA is not responsible for typographical or photographic errors on this Site.

1. PROPRIETARY RIGHTS AND TRADEMARKS

All Site content and collective work comprising the Site, including information, articles, data, software, photographs, graphs, videos, typefaces, graphics, music, sounds and other artwork and material (collectively “Content”) is protected by copyright, trademark, patent or other proprietary rights under United States and/or international laws and held by AKITA and/or the original creator of the material, including AKITA’s suppliers and/or affiliates. These rights are valid and protected in all forms, media, and technologies existing now or developed in the future. All trademarks, service marks, logos, slogans, domain names, and trade names are the property of their respective owners and are licensed to, or otherwise used with permission by, AKITA. All intellectual property used on the Site may not be reproduced, copied or otherwise manipulated in any manner without express, written permission of the owner. AKITA disclaims any proprietary interest in intellectual property other than its own.

2. SITE DOWNLOADS RESTRICTED

You may only download Content displayed on this Site for non-commercial, personal use, provided you also retain all copyright, trademark and other proprietary notices contained in our Content. Do not alter the Content, and do not copy or post the Content on any network computer or broadcast the Content in any media. Except as expressly authorized herein, or by an authorized representative of AKITA or by license, AKITA strictly prohibits modifying, transmitting, distributing, reusing, reposting, “framing” or using the Content of this Site and the Site servers, including the text, images, audio and/or video for public or commercial purposes or for any other purpose without AKITA’s written consent. Downloading images of products or services for sale within this Site are strictly prohibited. You may not copy, modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale, lease or rental of, create derivative works from, or in any way exploit the Content of this Site, in whole or in part. AKITA is not liable or responsible for any content provided by its users or other third parties for use on this Site. Contributions to this Site by third parties do not necessarily represent the view or opinions of AKITA. If applicable, AKITA may not preview user content before it appears on this Site. Users can be held liable for any illegal or prohibited user content they provide to this Site, including among other things, infringing, defamatory or offensive materials. 3. PAYMENT TERMS

AKITA does NOT currently accept all major credit cards and debit cards through a secure payment processor.  But in the future please check back here for upcoming membership subscriptions. AKITA follows payment terms that typically require an upfront deposit or full payment before services begin, with remaining balances due according to specific schedules like weekly, monthly, or upon service commencement. Common terms also include non-refundable deposits, policies for cancellations and no-shows, and currently NO options for payment plans or financing. In the event of a failed payment, we reserve the right to retry the payment or suspend access to your account and services until the balance is paid. AKITA reserves the right to charge late fees or terminate accounts or services for unpaid balances.

4. REFUND POLICY

At AKITA – Personal Dog Trainer, we stand behind the quality of our sessions and digital products. Once training has begun, refunds are generally not provided, except in cases of verifiable extenuating circumstances reviewed at our discretion.

Cancellations & Rescheduling

Clients are required to provide at least 24–72 hours’ notice (as specified in their individual contract) to cancel or reschedule a session. Cancellations made without sufficient notice may forfeit the session or incur a late cancellation fee. We understand that emergencies can arise, and we strive to accommodate rescheduling whenever possible. In most cases, we may issue a credit toward a future session or offer a make-up lesson, rather than a monetary refund.

Deposits & Prepaid Packages

All deposits are non-refundable, unless otherwise stated in writing prior to the start of training. For multi-session packages, refunds will not be issued after the first session, but any remaining balance may be transferred to another eligible dog or household member, at trainer’s discretion.

Digital Products

All digital downloads and online materials are final sale due to their instant-access nature. If you encounter an issue with a digital file or product, please contact us for a replacement or technical assistance.

Trainer Cancellations

In the rare event that AKITA – Personal Dog Trainer must cancel permanently (e.g., illness, relocation, or unforeseen emergency), clients will receive a full refund for any unused sessions.

Behavioral Outcomes

While every effort is made to support your dog’s success, training results depend on multiple factors including the dog’s temperament, environment, and handler consistency. For this reason, no specific behavioral outcomes are guaranteed, and refunds are not issued based on results.

5. APPLICABLE LAW

This Site is created, operated and controlled by AKITA in the State of New Jersey, United States of America. The laws of the State of New Jersey will govern the Site without giving effect to any principles or conflicts of laws.

6. LINKS TO THIRD-PARTY SITES

This Site may contain links to other sites operated by third parties, including third-party sites that display AKITA – Personal Dog Trainer trademarks (“Third-Party Site(s)”). These links are available for your convenience and are intended only to enable access to these Third-Party Sites and for no other purpose. AKITA does not warrant or make any representation about the substance, quality, functionality, accuracy, fitness for a particular purpose, merchantability or any other representation about any Third-Party Site or its content. A link to a Third-Party Site from this Site does not constitute sponsorship, endorsement, approval or responsibility of any such Third-Party Site. AKITA makes no representation or warranty as to any products or services offered on any Third-Party Site. The conditions of use, legal notices and privacy policy of any Third-Party Site may differ substantially from the Terms of Service that apply to your use of this Site. AKITA is providing this site and its contents on an “as is” basis and makes no representations or warranties of any kind, either express or implied, including, without limitation, warranties or conditions of title or implied warranties of merchantability or fitness for a particular purpose, and non-infringement. Although AKITA believes the content to be accurate, complete, and current, AKITA – Personal Dog Trainer does not represent or warrant that the information accessible on this site is accurate, complete, or current. AKITA does not guarantee any expected results will be achieved.

8. DISCLAIMER OF LIABILITY

In no event shall AKITA be liable for special, indirect, exemplary, or consequential damages or any damages whatsoever, including but not limited to, loss of use, data, or profits, without regard to the form of any action, including but not limited to contract, negligence, or other tortuous actions, all arising out of or in connection with the use, copying, or display of the contents of this site.

9. SECURITY AND PROHIBITED CONTENT

By using this Site, you agree that you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer and account, and you accept responsibility for all activities that occur under your account and password. If you access this Site on a public computer or use a computer to which multiple people may have access, follow all relevant instructions to sufficiently disconnect and log off of this Site and the computer system you are using to prevent unauthorized access to your AKITA account. Unlawful activities on this Site are strictly prohibited. This includes tampering with this Site, misrepresenting the identity of a user, using buying agents or conducting fraudulent activities. You agree not to use or attempt to use any engine, software, tool, agent, data or other device or mechanism (including browsers, spiders, robots, avatars or intelligent agents) to navigate or search this Site other than the search engine and search agents provided by AKITA or publicly available browsers. 10. SESSION ACCESS

Training sessions are provided by appointment only and must be scheduled in advance. Clients will receive confirmation details including time, location, and session format (in-person or virtual).

For in-person sessions, access to the property and dog must be safe, controlled, and compliant with all local laws and community guidelines. The client is responsible for ensuring the training environment is suitable, free of hazards, and that the dog is secured prior to the trainer’s arrival.

For virtual or remote sessions, clients are responsible for maintaining a stable internet connection, functional device, and access to any required video conferencing platform. Technical issues on the client’s end that prevent session participation may result in forfeiture of that session unless rescheduled at trainer’s discretion.

Session duration begins at the scheduled start time, regardless of client arrival or readiness. Late arrivals may result in reduced training time without refund or credit.

Training sessions, materials, and recordings (if applicable) are for the client’s personal use only and may not be shared, copied, or redistributed without written permission from AKITA – Personal Dog Trainer. We encourage frequent, consistent training to maximize your dog’s learning and long-term success.

11. TERMINATION

AKITA reserves the right to terminate or suspend your account or service at any time without notice if you violate these Terms of Service, engage in unlawful activity, or misuse the Site. Upon termination, your right to use the Site and access purchased content will immediately cease.

12. INDEMNITY

You agree to indemnify and hold AKITA and its officers, agents, employees, and other partners, harmless from any loss, liability, claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your access to the AKITA Site or use of its services offered, your use of the AKITA Site, any content posted, uploaded or transmitted by you, your use or distribution of any content, your violation of these Conditions of Use, any use of your account or password by you or any third party, or the infringement or other violation by you, or any third party using your account or password, of any intellectual property or other right of any person or entity.

13. AT YOU AND YOUR DOG’S OWN RISK

If you choose to use AKITA’s dog training services, you acknowledge and agree that your dog(s) are participating at their own risk and AKITA is not responsible for any kind of injury, death or health complication that occurs to your dog(s) during the dog training services provided by AKITA. If you have any concerns about your dog’s health or safety, please consult with your local veterinarian regarding your dog’s health before enrolling.

14. CHANGES/UPDATES TO TERMS OF SERVICE

Because our Site and services will continue to evolve, our Terms of Service are subject to change. We reserve the right to change or update our Terms of Service and to modify or terminate the Site for any reason, without notice or liability to you. As a user, you are responsible for regularly reviewing these Terms.

15. PRIVACY POLICY

Please refer to our Privacy Policy for information about how we collect, use, and protect your data.

16. CHILDREN’S PRIVACY

This Site and our services are not directed toward children under the age of 13, and we do not knowingly collect, use, or disclose personal information from anyone under 13 years of age. If we become aware that we have inadvertently collected personal information from a child under 13 without verified parental consent, we will take immediate steps to delete that information from our records. Parents or guardians who believe their child’s information may have been collected are encouraged to contact us directly so we can promptly address the matter. 

17. FORCE MAJEURE

AKITA shall not be held liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, war, natural disasters, pandemics, or interruptions to internet services.

18. SEVERABILITY AND WAIVER

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force. AKITA’s failure to enforce any right or provision shall not be deemed a waiver of such right or provision.

AKITA expressly disclaims any kind of guarantee of results. You are fully responsible for your dog’s progress. Always consult your local veterinarian for any concerns.
